You guys are treading deep water. Becker has NOT been found guilty, and when all of the charges are dismissed, he can and may come after you for defamation of character.. The problem with Racine is we have become infected by the Illinois Machine.
Why hasn’t anyone called the FBI? They are the ones needed when something becomes as corrupt as our city has become. All a person has to do is look at how Becker is being prosecuted, and they can see the barn isn’t smelling like roses.
The term defamation of character is often used to describe accusations of slander, libel or both. Slander involves verbal derogatory statements, while libel involves written ones. In a court of law, the plaintiff pursuing the lawsuit would charge defamation of character to cover any form of false or damaging allegations.
ReplyDeleteDefamation of character is notoriously difficult to prove in court, although the actual effects can be quite evident and damaging.
Becker admitted and signed the chat transcript stating that was the responbile party during the "chat" with the DOJ agent. Pornographic images were found on his computer. Based on his own admission at this point there are no false or damaging accusations as to the alleged crimes he has committed. He brought this on himself.
Another problem concerning defamation of character is the actual truth of the statement. Some may argue that in order for defamation of character to occur, the alleged victim actually has to have character to defame in the first place.
ReplyDeleteStephen Simanek is the judge assigned to this case... he's not running for re-election, not saying anything other than he's not running for reelection
ReplyDeleteHuck Finn,
ReplyDeleteTreading deep water. I can walk on water, at the moment I sink about two inches, but I'm working on it.
As for defamation of character. Fuck him...he belongs in jail under his on admission.
And I'll tell him to his face, in front of the FBI, CIA, Sponge Bob and Popeye!
Huck, you may well be right. I know that Becker is legally innocent until proven guilty. If he were simply charged and none of the evidence was known to the public, I wouldn't have much to say. The two most important things in my opinion are 1) the porn on the computer and 2) the sting - he showed up in Brookfield for a reason and we ALL know what that reason was. As far as I'm concerned, he was caught in the act. I know that might not be the way a court of law sees it, but it is the common sense, truthful way.
ReplyDeleteI also know that the law often has little to do with common sense or the truth. Sons of bitches have been twisting it and perverting it for centuries. I fully expect Becker to walk away unscathed by this. However, that will change what he is not one whit. Nor will suing me or anyone else change what he is.
Earlier today I decided that I am sick of the stink of this whole mess. These people remind me of all the other slime balls I have met in my life.
I was taught as a child that each lie is like a crack of the whip on the bared back of our Savior prior to His crucifixion. I don't think even He has enough back to take all of the hits from this town.
I've been pondering your blog, huck. I don't think anyone here has accused him of anything he hasn't already admitted to. People are angry and I believe with reason.
ReplyDeleteTaking pictures of someone on the street is legal. Associating with an accused child molester is not illegal by our aldermen and women, but it does raise questions as to why. Those are reasonable questions that the public should be allowed to ask. The general good of the public is supposed to be served by these people.
If you watched the Dateline news programs, those men were handcuffed and taken to jail for the very same thing. Becker not only walks free among all of us and our children, he flaunts it in his words and actions. (Racine Post interview)
I think people want to make sure the crime isn't forgotten. Citizens want to see the correct punishment enforced. When elected officials are still hovering around him, it gives the impression justice will not be served.
I don't want any of you guys to get splattered with is mud is all.
ReplyDeleteThank you for your concern, Huck. I don't know if it would take the FBI or what, but I've often said in the past that Racine's criminal justice system is in dire need of federal investigation. I've been on both sides of the law on this one. My insane upbringing and years of active alcoholism often put me in touch with the authorities in Racine and the lawyers. It is an open, sad, sick joke. The judges and lawyers are all buddies and work together to keep the system running. Most people in Racine will never have any contact with this part of our local government. They have no idea of what goes on. The lawyers brag about their influence. It is disgusting.
ReplyDeleteAnd when Becker walks, there will be a howl of protest on the blogs, but absolutely NOTHING will be done about it. Because this is Racine, and that is the way it is in Racine. From my very first appearance before a judge 45 years ago to this day, it is the same crooked mess.
What concerns me is why am I getting involved in this pile of manure at this point in my life? I guess that after all those years of madness, I thought I might "help out" somehow. I see now that was a mistake. There is no way for the common person to fight the powerful who own the "justice" system in Racine, nor to fight those who own the city government.
Truth simply is immaterial in Racine. Appearance is all. Party, party, party while the filth backs further and further up into our lives.
And a big thank you to ALL the media in Racine for helping to perpetuate this disease of our city.
ReplyDeleteParty on!
Huck - haven't read what you're referring to, but what some of the posters have said is true. Given the fact of that "signed" transcript, libel would be very difficult.
ReplyDeleteAdditionally, since Becker is a public figure, the burden of proof that allegations are false and he's been harmed by said libelous allegations rises to whole new, even more difficult, level.
Accusing Becker of murder or extortion would be one thing. But, a running commentary on a public figure and his exploits is well protected speech.
ReplyDeleteOrbs, I don't think the outrage if Becker gets off will be limited to the blogs. I have a feeling there will be people that would take justice into their owns on this one and there won't be a witness to anything (think that is what it is coming down to)
