HOT Government Files Lawsuit on Racine Unified School District (RUSD)

Racine: A formal Appeal with complaint to follow has been filed against the RUSD (Racine Unified School District) referendum that was voted on in the April 7 election. Attorneys Vincent Bobot (414-430-1249) and Michael Maistelman (414-333-9700) representing HOT Government, a local advocacy group for Honest, Open and Transparent Government, three petitioning groups, which include the Racine Taxpayers Association and the Racine Libertarian Party. The appeal highlights several problems with both the initial vote and the recount that was conducted under RUSD supervision and claims that the integrity of the vote on the billion-dollar referendum was completely lost and is not recoverable. Jim Sewell member of the Libertarian party stated “That when the recount started he was under the assumption that it was a truth finding process, but quickly realized it was an adversarial process: the recount was run by someone hired by the school district, and important decisions were made by the Unified Board of Canvass, all employees of the school district who want the referendum to pass. The petitioners firmly believe that regardless of how those complaints are resolved, the will of the voters has become impossible to determine and it would be reckless and irresponsible to move forward on spending a billion dollars under present circumstances. Yesterday I went out taking pictures of the Root River and North Beach to share with everyone. I just could not believe what I seen going out there. I took the Root River pictures on my way to pick up Drew from work and then we both went to the North Beach. While we were at the North Beach we started to talk to this guy and realized he was taking videos for TMJ4 news station. I thought that was really neat and he was asking Drew about the birds in the water. Here are the pictures.

Dear Citizens of Racine,

While you are going about your day to day, the few who care enough about their and your future have taken action action to reign in the rampant spending beyond the budget of RUSD, one of the worst districts and school systems in the entire state of Wisconsin. And those people have voted with their pocketbooks against RUSD.

Instead of just teaching our children, RUSD looks for new ways to overreach and spend money families desperately need themselves. Each and every spending boondoggle RUSD has engaged in the name of education has yielded ZERO results. It is time to just say NO to RUSD, which is more than ample reason to challenge this sham of a referendum.

Coronavirus Pandemic Likely to Last Two Years, Report Says



The coronavirus pandemic is likely to last as long as two years and won’t be controlled until about two-thirds of the world’s population is immune, a group of experts said in a report.
Because of its ability to spread from people who don’t appear to be ill, the virus may be harder to control than influenza, the cause of most pandemics in recent history, according to the report from the Center for Infectious Disease Research and Policy at the University of Minnesota. People may actually be at their most infectious before symptoms appear, according to the report.
After locking down billions of people around the world to minimize its spread through countries, governments are now cautiously allowing businesses and public places to reopen. Yet the coronavirus pandemic is likely to continue in waves that could last beyond 2022, the authors said.
“Risk communication messaging from government officials should incorporate the concept that this pandemic will not be over soon,” they said, “and that people need to be prepared for possible periodic resurgences of disease over the next two years.”
Developers are rushing to make vaccines that may be available in small quantities as early as this year. While large amounts of vaccine against the 2009-2010 flu pandemic didn’t become available until after the outbreak peaked in the U.S., one study has estimated that the shots prevented as many as 1.5 million cases and 500 deaths in that country alone, the report said.
The report was written by CIDRAP director Michael Osterholm and medical director Kristen Moore, Tulane University public health historian John Barry, and Marc Lipsitch, an epidemiologist at the Harvard School of Public Health.

With Video: 6th Street fire started in bedroom, results in $150K in damage

A fire that fully engulfed a building broke out on Thursday afternoon in the 300 block of 6th Street. The fire was in the storefront building next to Butcher & Barrel Gastropub, 300 6th Street. The fire was first reported at 3:10 p.m. Thursday. The cause was not immediately available nor was the extent of the damage. 

RACINE — A structure fire in Downtown Racine on 6th Street on Thursday afternoon caused an estimated $150,000 in damage and displaced at least four tenants. 

The fire was next to Butcher & Barrel Gastropub at 300 6th Street. The fire was first reported at 3:13 p.m. Thursday. 
A Racine Fire Department release sent at 8 p.m. said the fire started in a second floor bedroom, but the cause was still under investigation. 
At least four tenants lived in apartments in the upper levels of the building, according to Racine Fire Department Battalion Chief Willie Hargrove. No injuries were reported. 
Firefighters were able to help rescue two cats that were in the building, Hargrove said.
No estimate was immediately available on the extent of the damage.

The Root River

Yesterday when I was on my way to pick Drew up from work I took a look at the Root River on 4 Mile Rd and it was high. So when Drew got off of work I went and took a look at the Root River on 5 Mile Rd and I took some pictures of how high it was.

This morning when I was taking Drew to work it was just starting to get some light outside and I seen the Root River on 4 Mile Rd again and it was even higher from yesterday. So when Drew gets off of work today I am going around and getting some pictures to share with you tomorrow. The beach is even flooded.

Part of North Beach was flooded on Thursday morning after Racine received over 3 inches of rain in three days. 

RACINE — More than 3 inches of rain in three days left North Beach partly covered with water, nearly up to the beach sidewalk.



From Monday to Thursday morning, Racine received 3.51 inches of rain, with 1.6 inches from 7 a.m. Wednesday to 7 a.m. Thursday, according to the National Weather Service at Sullivan.
There is a lakeshore flood advisory in effect until Thursday afternoon from Sheboygan to Kenosha counties.

What you should know if you're starting a garden in the Milwaukee area

For new gardeners who want to start a garden bed, there are just a few steps that have to be followed.
Start with a small garden, as it’s easy to expand in future years, said Jayson Force, product manager at Burpee Plants in Chicago. An area that measures about 6 by 8 feet is a good start. When picking a location, make sure it gets at least six hours of sun a day and is near a water source.
Next dig out the grass if it’s not a raised bed, and then dig into the ground and break up the soil. Remove as many stones and weeds as possible and break up large clumps of earth. Add about 2 inches of compost, then work it in with a shovel or metal rake until the ground is fairly loose.
Next, plant your plants or seeds. When you plant depends on soil temperature and what you are planting. Depending on the crop, soil temperature could be anywhere from 45 to 75 degrees. Check seed packets for ideal temperature and to see how fast the plants will germinate and produce food. Also check the packets to see how deep to plant your seeds.
Once you have planted, add an all-purpose slow-release fertilizer. You will need to add fertilizer again halfway thought the summer.
Keep an eye on your new garden. Watch for signs of disease like discoloring, wilting and insect damage. Stake large plants as needed to keep air flowing around the lower leaves. If there are animals such as deer and rabbits in your area, circle the plants with a light-gauge wire mesh to protect them. Keep plants watered well.
Lastly, to harvest your vegetables when they are ripe, use a sharp pruner to remove fruit from plants and to shear herbs as cleanly as possible. Pick fruit when ripe to ensure continuous production.

What crops to grow

In addition to how to plant a garden, new gardeners also need to decide what crops to plant.
Force said he’s seeing gardeners buying a mix of seeds, but that tomatoes and peppers are the favorite.
 “After that its cucumbers, followed by eggplant. … Also the herbs are very popular right now. People are seeing all these cooking shows while they are at home, and they say to use fresh herbs, and most people don’t have them. All you need is a patio pot to grow most of them,” he said.
Beans, lettuce, eggplant and cucumbers are good for new gardeners because they are easy to grow, said Mike Holt, resale manager at Minor’s Garden Center in Milwaukee.
If a garden bed is too big of a commitment, container gardens are another option; especially for those with small spaces.
If you just want a couple fresh tomatoes, do them in a container, said Brian Uebelacker, general manager at Minor’s Garden Center, “There’s almost nothing you can’t grow in a container except watermelon, as it would take over the patio, and you wouldn’t get a lot of fruit. You couldn’t do corn either,” he said.
Another option for growing plants is to use Smart Pots, which are made of a durable fabric, said Zannah Crowe, horticulturist at Johnson’s Gardens. “They are perfect for vegetable gardening. We grow potatoes in them every year,” she said.

Aaron Rodgers likely will finish his career somewhere other than Green Bay, said someone who should know: former Packers quarterback Brett Favre.
Appearing Wednesday on the Rich Eisen Show, Favre was asked what he thought was in store for Rodgers after the team's decision to select quarterback Jordan Love in the first round of last week's NFL draft.
"I think he'll play somewhere else," said Favre, who moved on from Green Bay after a storied career and spent his final three seasons with the New York Jets and Minnesota Vikings. "That's my gut."
Favre told Eisen that he had spoken to Rodgers since the draft.
"I guarantee you (the Love pick) got the wheels turning in Aaron's mind," Favre said. "That means there's a chip on his shoulder toward the organization that otherwise was not there. All (Rodgers) needed was a reason (to play elsewhere)."

NOW COMES the Plaintiff Sandra Weidner to move to recuse Judge Eugene Gasiorkiewicz from the above entitled matter under the following authorities:
28 USCS Sec. 455, and Marshall v Jerrico Inc., 446 US 238, 242, 100 S.Ct. 1610, 64 L. Ed. 2d 182 (1980).  "The neutrality requirement helps to guarantee that life, liberty, or property will not be taken on the basis of an erroneous or distorted conception of the facts or the law." 
The above is applicable to this court by application of  Article VI of the United States Constitution and Stone v Powell, 428 US 465, 483 n. 35, 96 S. Ct. 3037, 49 L. Ed. 2d 1067 (1976).
"State courts, like federal courts, have a constitutional obligation to safeguard personal liberties and to uphold federal law."


The court’s record speaks for itself.
The court ruled in most bias and complicit ways, ruling against the Plaintiff’s right to amend her complaint within 6 months. Then came the court’s erroneous rulings of privileged documents and Gasiorkiewicz’s illegal, outrageous criminal acts of sealing the entire court record to create an illegal secret court. In doing so Judge Gasiorkiewicz has knowingly and willingly violated the following:

BACKGROUND:
.Judge Gasiorkiewicz has a history of deliberately violating other litigant's personal liberties and/or has wantonly refused to provide due process and equal protection to all litigants before the court and/or has behaved in a manner inconsistent with that which is needed for full, fair, impartial hearings.
The United States Constitution guarantees an unbiased Judge who will always provide litigants with full protection of ALL RIGHTS.   Therefore, the Plaintiff respectfully demands Judge Gasiorkiewicz recuse himself in light of the evidence attached within this motion and Exhibits 1,2,3,4,5,6  detailing unethical/ illegal/criminal misconduct or conduct which gives the Plaintiff good reason to believe Judge Gasiorkiewicz cannot hear this case in a fair and impartial manner.

CONCLUSION:

A criminal has no business being on the bench

In Wisconsin, a Circuit Court Judge is required to be a Wisconsin licensed attorney.  A Wisconsin attorney’s license requires the holder of the license to adhere to the rules of law, not act as a rogue attorney or judge as Gasiorkiewicz has done in this case. 

Gasiorkiewicz acting as judge compounded these offenses against both the Plaintiff and the Public as he trashed the rules of law and judicial conduct in this case in favor of his ego and undisclosed agenda(s).

Ethical and criminal complaints have been filed against judge Gasiorkiewicz into the Wisconsin Judicial Commission and the Wisconsin Attorney General’s office concerning this case.  The facts are indisputable and irrefutable that judge Gasiorkiewicz disregarded the rule of law and overstepped his assigned judicial boundaries, committed gross violations of the law, committed crimes and aggrieved both Plaintiff and Public in the process of conducting court.

As noted by the COA,  Judge Gasiorkiewicz wrongfully denied Plaintiff the right to amend her complaint, what the COA negligently failed to acknowledge is Gasiorkiewicz illegally sealed the entire court record creating an illegal secret court contrary to Wisconsin statutes and the First Amendment of the U.S. Constitution, thus violating his oath of office and making Gasiorkiewicz a “Constitutional Infidel” and unfit for public service.

Judges, both individually and collectively must respect and honor the judicial office as a public trust.  Judges must strive to maintain the trust and confidence of the legal system. The effectiveness of the judiciary rests ultimately on the trust and confidence that the people confer upon judges.

Judge Gasiorkiewicz while conducting court engaged in war upon the Plaintiff’s rights and that of the Public.  The judge gagged the Plaintiff with his illegal secret court and placed her in a most dark situation as Gasiorkiewicz kept hidden from the Public his criminal acts.

Judge Gasiorkiewicz trashed the public confidence and trust of our court system and became a national embarrassment to anybody affiliated to the Wisconsin Courts.
Gasiorkiewicz knowingly and willingly violated his judicial trust by violating the rules of law as stated in this motion.

Judge Gasiorkiewicz belongs in prison, not on the bench, is unfit for public service and therefore for all of the above must recuse himself from this case and ALL cases.

(3) Whether by act of commission or omission, in the officer's or employee's capacity as such officer or employee exercises a discretionary power in a manner inconsistent with the duties of the officer's or employee's office or employment or the rights of others and with intent to obtain a dishonest advantage for the officer or employee or another;

First Amendment of the U. S. Constitution:
The First Amendment guarantees that American court proceedings are presumptively open to the public. The U.S. Supreme court has explained the public's presumptive rights of access to court proceedings are rooted in both logic and history.

SCR 60.02 A judge shall uphold the integrity and independence of the judiciary. An independent and honorable judiciary is indispensable to justice in our society.
SCR 60.03 A judge shall avoid impropriety and the appearance of impropriety in all of the judge's activities. (1) A judge shall respect and comply with the law and shall act at all times in a manner that promotes public confidence in the integrity and impartiality of the judiciary.
SCR 60.04 and its subsections 
A judge shall perform the duties of judicial office impartially and diligently. The judicial duties of a judge take precedence over all the judge's other activities. The judge's judicial duties include all the duties of the judge's office prescribed by law.

As a matter of due process, a judge who fails the “appearance of impartiality” test may not sit as the judge in the case. In this case, when a pretrial ruling concerning the appointment of additional counsel was appealed, the judge appeared as a nominal party in the appellate court but actually filed a pleading, urging that the ruling was proper and that the simplicity of the case (implying that the evidence of guilt was overwhelming) justified the decision to deny the appointment of two lawyers in this death penalty case. That pleading also questioned the ability of the lawyer who was representing the defendant. The Ninth Circuit held that the state trial judge’s participation in the appeal may have rendered her too biased to participate in the death penalty proceedings that ensued in the trial court. A remand for a full evidentiary hearing on the state judge’s impartiality was required.
