A unanimous Wisconsin Supreme Court struck down a state law Friday that allowed for taking blood samples from suspected drunken drivers who are incapacitated, ruling that it is unconstitutional.

The court upheld a state appeals court ruling from last year saying that the law violates the Fourth Amendment protecting against unconstitutional search and seizure. The law in question says that incapacitated drivers — those who are unconscious due to drugs or alcohol — are presumed to have agreed to provide blood samples if there is probable cause they were impaired.

Numerous court rulings, both in Wisconsin and across the country, have addressed the issue of taking blood samples from drivers without consent. But until this case the courts had never directly addressed whether the incapacitated driver provision of Wisconsin’s law violates the Fourth Amendment.

The state Supreme Court, in its ruling written by Justice Ann Walsh Bradley, said the state law is clearly unconstitutional.

The case involved a 2014 car crash in a suburb of Madison between two vehicles that killed Janet M. Grady, who died at the scene. Fitchburg police took blood samples from the surviving driver, Dawn Prado, because the officer believed a warrant was not needed to take the sample.

Prado, who was intubated and unconscious at the hospital, did not respond when an officer asked her for consent to do a blood draw. The officer testified that he did not think he needed a warrant since she was incapacitated and ordered a nurse to draw the blood.

The Dane County circuit court sided with Prado and suppressed the blood draw test result and dismissed the case. A state appeals court said the officer acted in good faith even though taking such samples is unconstitutional, ruled that the blood test results should not have been suppressed but said the state law about incapacitated drivers is unconstitutional.

The appeals court threw out the lower court's ruling dismissing Prado's conviction.

The state Supreme Court on Friday agreed with that ruling, saying the officer acted in good faith based on an unconstitutional law. Justice Pat Roggensack and Chief Justice Annette Ziegler filed a separate concurring opinion, saying they agreed with the end result of the ruling but not the reasoning.

A criminal complaint said Prado had a blood alcohol concentration of 0.081%, just over the legal limit in Wisconsin, when a vehicle she was driving crossed the center line on a highway in Fitchburg and struck Grady's car. Prado, 54, was also severely injured.

Because of three prior drunken driving convictions, Prado was allowed a 0.02% maximum blood alcohol concentration.

Anthony Jurek, the attorney representing Prado, did not immediately respond to a request for comment.

Vaxpocalypse: Four Vaxxed British Airways Pilots Dead, Airline in Crisis

 

How easy is it to cover up all the people dying of the coronavirus vaccine?

Just about as easy as it was to make you believe that people were dying of the virus.

Four British Airways pilots have recently died.

This was admitted by British Airways to Reuters, who did a fact check on these dead healthy pilots.

Following the Reuters article, the airline also posted unsolicited on Twitter that they didn’t die from the vaxx.

I say “unsolicited” because the person they responded to didn’t ask that question, but a lot of people on Twitter are saying it. This is a place where censorship hits a catch-22, because if you start banning everyone who asks questions about the vaccine-related deaths, you make people start to believe that the anti-vaxxers are right. It’s a balancing act where you have to decide if censoring is going to do more damage than ignoring.

In theory, we’re facing a situation where everyone on earth is going to post something on the internet that goes against the narrative. If someone sees people dying of the vaccine and asks about it and gets banned, then all of their friends see that they got banned for an innocent question, what does that do?

There is audio floating around of someone talking about these pilots dying of the vaxx and saying that British Airways is considering suspending all vaxxed pilots.

“They’ve had the third BA pilot die in the last seven days, yeah? Third pilot dead in the last week,” says the unidentified man in the recording. “The first two guys were in their forties and fifties; this guy, mid-thirties, perfectly fit, no underlying conditions. He gets his second jab and he’s dead within days, exactly the same with the first two.

“Because of this, BA are now in crisis talks with the government about whether to allow vaccinated pilots to fly. The issue with that of course is that about 80%, according to my friend in BA, 80-85% have been injected.”

The other crisis would be if a pilot got a blood clot or had a heart attack while driving the plane. You might think “well, there’s always the co-pilot.” However, in the UK, many co-pilots are affirmative action diversity hires.

Even more often than that, they’re women.

Just type “British Airways pilot” into an image search to get an idea of these demographics.

It’s in theory possible that a black co-pilot could land a plane after the pilot had a heart attack, but if the co-pilot is a female, there is a 100% chance everyone on the plane would die.

I hate to be the one to say it, but the fact is that a plane crashing due to a vaxxed pilot would be a really good thing, as it would be very difficult to cover up. Then again, they covered it up when the Ukrainians shot down that passenger jet – so who knows.

One thing is clear: the media’s grip on the narrative has never been looser than it is right now. It is sweaty and loose. You saw this with the response to the Tucker Carlson segment about the FBI involvement in the Capitol Storm. Everyone was losing their minds.

 TOKYO (AP) — A wild brown bear on the loose in a city in northern Japan wounded four people, entered a military camp and disrupted flights at an airport Friday before being fatally shot.

The bear was seen wandering through the streets of Sapporo in the early hours of Friday, triggering a number of calls to police. Over the next eight hours, Hokkaido police said the bear injured a woman in her 80s, a man in his 70s and a man in his 40s before attacking a soldier.

Police said the condition of those injured was not known, but the Asahi newspaper reported that the man in his 40s suffered serious injuries to his chest, back and limbs after he was mauled by the bear while walking on a street.

Video on local television showed the bear wandering a street in Sapporo. Chased by a car, it crossed a busy road and forced its way into the Ground Self-Defense Force’s Camp Okadama. The bear knocked down a soldier on duty at the gate.

The soldier suffered cuts to his chest and stomach, but his injuries were not life threatening, according to the Defense Ministry.

Next the bear ran through the camp and entered the runway at a nearby airport, causing several flights to be grounded.

The bear then ran into a forest, where it was shot by local hunters.

Toshihiro Hamada, an official at the Sapporo city environmental department, said authorities were investigating how the animal ended up in the city.

“We are sorry that four people were injured,” Hamada said.

Brown bears roam mainly in Hokkaido forests, but experts say they have been increasingly spotted in inhabited areas looking for food, especially during the summer.

Podcast king Joe Rogan has savaged CNN’s Brian Stelter for being under the thumb of the White House — and losing viewers with a “f–king terrible” show.

In the latest episode of “The Joe Rogan Experience,” the podcaster trashed Stelter for having complained about YouTube personalities like him getting more viewers than CNN “as if it was some horrible thing.”

“They were describing it as if they’re entitled to viewers,” Rogan, 53, noted of a panel discussion on Stelter’s “Reliable Sources” in January.

“This is because the market has spoken and your show’s f—ing terrible,” the UFC commentator said, not holding back any punches.

“Brian Stelter’s show keeps slipping and slipping and slipping in the ratings,” said Rogan, whose show has had hundreds of millions of views on YouTube and regularly leads the podcast charts.

Racine business burglary: Chicago man accused of stealing money, truck

A 28-year-old Chicago man faces multiple charges for allegedly breaking into a Racine business – and stealing cash and a truck. The accused is Terrance Hobson – and he faces the following criminal counts: 

  • Burglary of a building or dwelling
  • Operating a motor vehicle without owner's consent
  • Criminal damage to property
  • Possession of drug paraphernalia
  • Disorderly conduct, use of a dangerous weapon

According to the criminal complaint, police were dispatched to AC Auto Body and Repair on S. Memorial Drive in Racine on Monday, June 14 for a report of a burglary. The owner of the business told police her offices in the building were "completely ransacked" and there was surveillance video of what happened.

The complaint indicates the video shows the suspect "smashing the window on a door into AC Auto Body, reaching into the door to unlock it, and entering the building." The suspect then ransacked two offices and took a "large sum of money," the complaint says. The surveillance footage showed the entire incident happened between 4:38 a.m. and 5:41 a.m. on Monday.

The owner of the shop indicated in addition to cash being stolen, the suspect made off with "several items, and a vehicle that was being repaired at the business."

Several hours later, the complaint indicates Racine police were dispatched to a gas station on Lathrop -- where a male approached a woman and "openly stated he just stole a truck and offered her the vehicle in case she needed a car to drive." The complaint says the woman took down the plate of the vehicle -- and the male drove away. The woman also told police the man "was handing out money to people in the parking lot."

Later that same afternoon, an officer was sent to a residence on College Avenue in Racine. The complaint indicates there was a 911 hangup -- and that dispatch "could hear a lot of yelling and screaming in the background before the call hung up." When the officer arrived on the scene, he observed Hobson standing next to the truck stolen from the auto body shop. He was taken into custody without incident. The officer noted Hobson "was loud, aggressive, and making statements that did not make sense."

The officer then spoke with witnesses at the College Avenue scene -- and learned Hobson had been "threatening to hit, beat up, and kill" the witness and one other person. The complaint says Hobson "got a golf club out of the back of the (stolen truck) and began swinging it" as if he was going to hit her.

Investigators conducted a search of the stolen truck. The complaint says they found drug paraphernalia and "a green leafy substance that appeared to be marijuana."

Hobson made his initial appearance in Racine County court on Wednesday, June 16. Cash bond was set at $5,000 -- and he is due back in court for a preliminary hearing on June 23.

Racine stabbing, man charged with homicide attempt

A 55-year-old Racine man is charged with attempted first-degree intentional homicide for a June 13 stabbing.

Prosecutors say Anthony Harrison stabbed a man, puncturing his lung, after being woken up.

Police were called to the scene near Hagerer and Marquette and spoke with Harrison upon arrival. A criminal complaint states Harrison had "a large amount" of blood on his clothes and a cut on his finger.

According to the complaint, Harrison said he "cut" the victim and the knife was inside the house. Officers found the knife on the living room floor.

Harrison said he was asleep in the living room when the victim woke him up and he said, the complaint states, the victim attacked him. He did not provide details of the attack, but admitted the knife was his.

A witness said he awoke to Harrison and the victim arguing and grappling before the victim stepped away full of blood. The witness said Harrison admitted to stabbing the victim "because he was sick of him," according to the complaint. Harrison also told police that the victim was a homosexual and that he was "getting sick of this (expletive) gay (expletive)."

The complaint states the victim underwent surgery for a collapsed lung. Police later spoke to him, and he said there was an ongoing dispute between him and Harrison about a dog. The victim said, according to the complaint that, Harrison called him derogatory names for homosexuals. 

The victim said he went to leave the room when the physical altercation started, and he believed Harrison threw the first punch. He didn't realize he had been stabbed until about 10 minutes into the fight when they separated, according to the complaint.

Racine hit-and-run: Pedestrian struck, man charged

A 22-year-old Racine man is charged in connection to a June 11 hit-and-run.

Prosecutors allege Samuel Thurman struck a pedestrian near 16th and Blaine – and kept driving.

According to a criminal complaint, Racine police arrived at the reported hit-and-run scene and found the victim laying on the street. A criminal complaint states she had contusions and scrapes on the right side of her forehead and her right cheek. She was taken to the hospital for treatment.

A witness told officers, the complaint states, that the victim was crossing the street in the crosswalk when a white sedan hit her. The witness said the victim slid across the hod and went airborne over the windshield, tumbling in mid-air before falling to the street. Surveillance video corroborated the witness' account.

Police later found the suspect vehicle and driver – since identified as Thurman. Thurman admitted that he was driving during the hit-and-run. He also admitted to smoking marijuana roughly three hours prior to the incident. Officers also found an open vodka bottle in the car.

Thurman is scheduled for a preliminary hearing on June 30.

TAKES ON RUSD APPEAL


On Wedsnesday, 6-16-2021, the Wisconsin Supreme Cour issued an order that the petition for review as submitted by the Racine Taxpayers Association (Dennis Montey, president), The Southeastern Wisconsin Libertarian Party (Jim Sewell, treasurer) and HOT Government (George Meyers, secretary) has been granted and they are to submit legal briefs pursuant to the courts order.

Attorneys M. Samir Siddique (414-308-6095) and Vincent Bobot (414-430-1249) are representing HOT Government, a local advocacy group for Honest, Open and Transparent Government, along with the Racine Taxpayers Association and the Racine Libertarian Party.

“This is a big step forward” Meyers stated at a HOT government meeting. Neither the Circuit Court nor the Appellate court would give us the time of day to hear our issues with this recount.  Meyers claims both Judge Piontek and the Appellate Court Chief Justice Lisa Neubauer had connections to the Racine Unified School District (RUSD) which limited their ability to view our arguments rationally and without bias.

The 30 year, Billion Dollar RUSD referendum held on April, 2020 allegedly passed by five votes out of over 30,000 votes casted. The votes were counted, tabulated, canvassed and recounted by employess of the Racine Unified School District.

Meyers claims that the recount showed that Unified had actually lost the referendum by 14 votes but by some kind of trickery manipulated ballots to come up with a five vote victory.

Petitioners Montey, Sewell and Meyers were not allowed to look at or inspect the ballots during the vote count to determine how the "magic trick" was done, with RUSD claiming covid concerns

MADISON - Assembly Republicans approved bills Wednesday that would ban transgender athletes from competing in girls' and women's athletics — proposals that have pushed Wisconsin into a national firestorm.

Passage of the legislation came amid opposition from nearly 30 organizations, including the statewide body that regulates high school sports and the state's Big Ten Conference university.

Backers of the bills said they would ensure girls and women don't face unfair competition.

"These bills are about fairness and inclusion, making room in competitive sports for everyone to feel comfortable," said Rep. Barbara Dittrich, an Oconomowoc Republican and lead sponsor of the measures. 

The measures, Assembly Bill 195 and Assembly Bill 196, passed 59-38 on party lines. They next go to the Republican-controlled Senate but face certain vetoes if they get to Democratic Gov. Tony Evers.

 "This is political theater that has turned into an exercise in cruelty and harm for young people and children in Wisconsin," said Democratic Rep. Lee Snodgrass of Appleton. 

"Winning is always more fun — but let's not lose sight of what athletics are about," said Democratic Rep. Mark Spreitzer of Beloit. "Most young people play sports because they enjoy the game, they enjoy being part of a team. They enjoy themselves and they enjoy competition. And these bills would deny those opportunities to transgender youth."

Health officials tracking new COVID-19 variant in Wisconsin

MADISON, Wis. (AP) — The Wisconsin Department of Health Services is tracking a new variant of COVID-19 with more than two dozen cases in the state.

The Delta strain has been elevated to a “variant of concern” in Wisconsin.

The strain is fueling the coronavirus surge in the United Kingdom and according to the Centers for Disease Control and Prevention is more contagious and more resistant to vaccines.

DHA says the vaccines currently available in the U.S. have been shown to provide some protection against the Delta strain. The department is tracking five other variants of concern in the state.
