I'm thinking if the girl would have just behaved she wouldn't have been in a time out to begin with.........She hyperventalated because she knew she did something wrong.
The problem with America is that we used to hear, "You got what you deserved so shut up or I'll add to the punishment" from our parents. Now it's rewarding bad behavior with lawsuits over a benign punishment.
My concern is what are teachers supposed to do with unruly children? I know that corporal punishment is no longer allowed. So, if time-outs are also no longer allowed, what's left?
Maybe we need to put a police precinct house in each school and have officers patrol the hallways. Then if someone misbehaves, a teacher can call the cops and have them immediately deal with it.
Many of these problems can be solved with a firm kick in the ass. This is the victim mentality run wild.

There is very little you can do. Kids know it too. You can go the blue slip/ slap of the hand route. The problem is that in the conference between the student and principal, they usually take the easy route and smooth everything over. The teacher looks like they are the one who made too much of a deal out of the situation. I'm not kidding!
The problem with police in the schools is that once they get involved, what usually happens is that it escalates and an unruly child winds up in handcuffs. No one wants to see a stupid moment/mistake by a child wind up in an arrest.
You need to choose your battles. I find off-the-wall humor in response to their unacceptable behavior is often more effective. (Of course not a method to use when it is a dangerous or over the top situation)
I have a friend who is a retired RUSD high school teacher. He told me how students would wander in and out of his classes at will. "Why didn't you do anything?" I asked. "You don't dare," he replied.
The inmates run the asylum at almost all public levels now.
Are we raising a bunch of woosies? My God, get your feelings hurt and file a lawsuit. When I was in the 8th grade, I had to sit outside in the hall because I had caused a disruption in the class. I had to endure teachers going by and looking at me and kids making fun of me. I did the crime and the time.
I wonder though, is there a statute of limitations on this? Can I file a lawsuit against Mitchell School for this?
I'm sure I must be scarred from this and therefore deserve compensation for it.
She should note be allowed to go on any school property until the lawsuit is final. If she fails because of lack of attendence to bad.
How can you sue someone and still want to use their services. It should not be allowed.
